A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.
"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The case stems from a erroneous removal to El Salvador in March, which US authorities later admitted was an error. Following his repatriation to the United States to answer alien smuggling charges, he was held in federal detention.
In her order, the court noted that the authorities does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
